
The Supreme Court heard a case this week about whether or not the state of North Carolina can attach a lien on a legal settlement won by a Medicaid recipient to reimburse the state for Medicaid payments to cover the recipient’s health care costs.
The case stems from an unnamed minor who was born with injuries due to her doctor’s negligence. The family received Medicaid to help cover medical costs but also filed suit against the doctor, winning the settlement.
The state then made claims on the settlement saying they needed to compensate the state for the Medicaid expenditures.
